Welcome to TruCare Painters! These Terms and Conditions (“Terms”) govern your use of our website at https://trucarepainters.com and the painting services provided by TruCare Painters Corp. (“TruCare Painters,” “we,” “us,” or “our”). By accessing our website, requesting an estimate, or engaging our services, you agree to be bound by these Terms. If you do not agree, please do not use our website or services.
1. Use of Website
You agree to use this website only for lawful purposes and in a manner that does not infringe on the rights of others or restrict their use of the site. You agree not to:
- Tamper with, hack, or attempt to gain unauthorized access to any part of the website
- Use automated systems (bots, scrapers, etc.) to extract data from the site
- Upload viruses, malicious code, or harmful content
- Misrepresent your identity or impersonate another person
- Use the site to transmit spam or unsolicited communications
We reserve the right to restrict access to anyone who violates these Terms.
2. Services
TruCare Painters provides interior painting, exterior painting, commercial painting, kitchen cabinet painting, and related services as described on our website. All services are subject to availability, scheduling, and weather conditions, and may be modified at our discretion.
Estimates are based on the scope of work agreed upon at the time of the estimate. Changes to the scope of work after the estimate is signed (such as additional rooms, surface preparation, or color changes) may result in adjustments to the price and timeline. Any change orders will be communicated and approved before the additional work is performed.
3. Estimates and Quotes
Written estimates provided by TruCare Painters are valid for 30 days from the date of issue, unless otherwise stated. Estimates are based on a visual inspection and the information provided by the customer. If conditions discovered during the project differ materially from those assumed in the estimate (such as hidden water damage, lead paint, or extensive surface repair needs), we will notify you and provide a revised estimate before proceeding.
4. Payment and Fees
All payments must be made according to the terms outlined in the signed estimate or invoice. Unless otherwise agreed in writing:
- A deposit may be required before work begins on certain projects
- Final payment is due upon completion of the work
- Accepted payment methods include check, credit card, and electronic payment
- Past-due invoices may be subject to a late fee of 1.5% per month (18% annual percentage rate) or the maximum allowed by South Carolina law, whichever is lower
- Failure to make timely payments may result in suspension of services, cancellation of warranty, and collection action
Returned check fees and any costs of collection (including reasonable attorney fees) are the responsibility of the customer.
5. Cancellations and Rescheduling
Customers may cancel or reschedule a confirmed project by providing at least 48 hours’ notice prior to the scheduled start date. Cancellations made with less than 48 hours’ notice may be subject to a service fee to cover scheduling, materials ordered, and labor allocation.
Deposits for custom-ordered materials (specialty paints, custom colors, etc.) are non-refundable once the materials have been purchased.
TruCare Painters reserves the right to reschedule work due to weather, illness, supply issues, or other circumstances beyond our control. We will provide as much notice as possible and work with you to find a new date.
6. Warranty
TruCare Painters provides a workmanship warranty on completed projects as specified in your signed estimate or contract. This warranty covers defects in our workmanship under normal conditions. The warranty does not cover:
- Damage caused by structural issues, settling, or moisture from outside the painted surface
- Normal wear and tear, fading from sun exposure, or color changes over time
- Damage caused by the customer or third parties after project completion
- Surfaces or substrates the customer declined to have properly prepared
- Areas where the customer requested we paint over an unsuitable surface against our recommendation
Warranty claims must be submitted in writing to info@trucarepainters.com within the warranty period.
7. Customer Responsibilities
To allow us to perform our services efficiently, the customer agrees to:
- Provide reasonable access to the work areas during scheduled hours
- Move or protect valuable, fragile, or sentimental items prior to our arrival (we will move standard furniture as needed)
- Ensure pets are secured and away from work areas
- Notify us in advance of any known hazards (lead paint, asbestos, mold, structural issues, etc.)
- Provide access to electricity and water as needed for the project
8. Limitation of Liability
To the fullest extent permitted by South Carolina law, TruCare Painters’ total liability for any claim arising out of or related to our services or website shall not exceed the amount paid by the customer for the specific services giving rise to the claim. We are not liable for indirect, incidental, special, consequential, or punitive damages, including lost profits, loss of use, or property damage not directly caused by our negligence.
Nothing in these Terms limits liability for gross negligence, willful misconduct, or any liability that cannot be limited under applicable law.
9. Insurance
TruCare Painters maintains general liability insurance and workers’ compensation coverage as required by South Carolina law. Proof of insurance is available upon request.
10. Intellectual Property
All content on our website — including text, graphics, logos, images, photographs of completed projects, and the TruCare Painters name and branding — is owned by or licensed to TruCare Painters and is protected by copyright, trademark, and other intellectual property laws. You may not reproduce, distribute, or use any content from our website for commercial purposes without our prior written consent.
We may photograph completed projects for our portfolio, marketing, and social media use. If you do not want photos of your project used in this way, please notify us in writing before the project begins.
11. SMS / Text Messaging
By providing your mobile phone number to TruCare Painters, you consent to receive text messages from us regarding your inquiry, appointments, estimates, project updates, and occasional promotional offers. Message and data rates may apply. Message frequency varies. Reply STOP to opt out at any time, or HELP for help. Full SMS terms are described in our Privacy Policy.
12. Third-Party Links
Our website may contain links to third-party websites or services. We are not responsible for the content, privacy practices, or accuracy of those sites. Accessing third-party sites is at your own risk.
13. Indemnification
You agree to indemnify and hold harmless TruCare Painters, its officers, employees, and subcontractors from any claims, damages, losses, or expenses (including reasonable attorney fees) arising from your violation of these Terms, your misuse of our website, or your violation of any third-party rights.
14. Governing Law and Dispute Resolution
These Terms are governed by the laws of the State of South Carolina, without regard to conflict of law principles. Any disputes arising under or related to these Terms or our services shall be resolved in the state or federal courts located in Greenville County, South Carolina, and you consent to the exclusive jurisdiction of those courts.
The parties agree to first attempt to resolve any dispute through good-faith direct negotiation before pursuing legal action.
15. Severability
If any provision of these Terms is found to be unenforceable or invalid, the remaining provisions will continue in full force and effect.
16. Changes to Terms
We reserve the right to update these Terms at any time. Updated Terms will be posted on this page with a revised “Effective Date.” Continued use of our website or services after changes are posted constitutes your acceptance of the updated Terms. For active projects, the Terms in effect at the time your estimate was signed will continue to govern that project.
